1. Acceptance of Terms

 

By accessing or using the website located at www.elliotbgolf.com and the golf instruction services ("Services") offered through it, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Site or the Services.

 

2. Services Provided

 

The Site promotes and facilitates the purchase and scheduling of golf instruction, which may include, but is not limited to:

• In-person lessons

• Online video analysis

• Group clinics

All services are provided by Elliot Bunyaviroch, a qualified golf instructor ("Instructor").

 

3. Payment and Fees

 

• Pricing: All prices for services are listed on the Site and are subject to change without prior notice.

• Payment: Payment for all services must be made in full at the time of booking or as otherwise specified. 

• Refunds: All sales are final. Refunds are typically not offered for services already rendered (such as a lesson that has taken place) or for digital products (e.g., e-books, video subscriptions). Refund policies for cancellations or no-shows are detailed in Section 4.

 

4. Cancellation and Rescheduling Policy

 

• Client Cancellation: If you need to cancel or reschedule an in-person lesson, you must notify the Instructor at least 24 hours in advance.

  • Cancellations made with sufficient notice will receive opportunity to rebook at no cost. 

  • Cancellations made with less than the required notice, or a "no-show," will result in a forfeiture of the full payment for that session.

• Instructor Cancellation: In the event the Instructor must cancel a session, you will be offered a full refund or the option to reschedule at a mutually convenient time.

 

5. Intellectual Property

 

• Ownership: All content on the Site, including all lesson materials, instructional videos, text, graphics, logos, images, and software, is the property of Elliot Bunyaviroch or its content suppliers and is protected by intellectual property laws.

• Limited License: You are granted a limited, non-exclusive, non-transferable license to access and use the content for your personal, non-commercial golf improvement purposes only.

• Restrictions: You may not copy, reproduce, distribute, transmit, display, sell, license, or otherwise exploit any content from the Site or Services for any other purposes without the express prior written consent of Elliot Bunyaviroch.

 

6. Disclaimer of Warranties and Limitation of Liability

 

• Golf is a Physical Activity: You acknowledge that golf instruction and practice are physical activities that carry inherent risks of injury. You voluntarily assume all risks associated with participation in our lessons and instruction.

• No Guarantees: The Instructor will provide professional guidance, but makes no guarantees regarding your specific golf performance or results. Your improvement is dependent on many factors, including your effort, consistency, and physical condition.

• Limitation of Liability: To the maximum extent permitted by law, Elliot Bunyaviroch shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, or other intangible losses, resulting from (i) your access to or use of, or inability to access or use, the Site or Services; (ii) any conduct or content of any third party on the Site; or (iii) any injury sustained during instruction.

 

7. Governing Law

 

These Terms shall be governed and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

 

8. Changes to Terms

 

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice before any new terms take effect. By continuing to access or use our Site or Services after those revisions become effective, you agree to be bound by the revised terms.
